Legal due diligence

Hire an English-speaking Vietnamese lawyer to verify the title (sổ hồng), confirm the 30% foreign quota has not been reached, and review your purchase agreement. Budget $500-$2,000.

Sign & deposit

Sign the purchase agreement and pay an initial deposit — legally capped at 5% of purchase price under Vietnam's 2024 Real Estate Business Law. Remaining payments follow a staged schedule.

Payments are tied to construction milestones. On handover, a final inspection is conducted. The title certificate (sổ hồng) is issued in your name within 3-6 months of completion.

Understanding your rights

The 50 + 50 year leasehold

Vietnam's Housing Law grants foreign nationals the right to purchase apartments on a 50-year leasehold, registered in your name. At expiry, you can renew for a further 50 years — an effective ownership horizon of a century. The property can be freely sold, gifted, inherited, or used as mortgage collateral throughout.

This is the same model used across Southeast Asia. Vietnam's version is arguably the most generous in the region, particularly following the 2024 Housing Law reforms which strengthened foreign buyer protections significantly.
